Welcome to Eustasia, an AI-powered music creation application operated by Larbsoft ("Company", "we", "us", or "our"). By using Eustasia, you agree to these Terms of Service ("Terms").
1. Eligibility
You must be at least 13 years old (or the minimum digital consent age in your country).
Users under 18 must have permission from a parent or legal guardian.
2. Description of the Service
Eustasia allows users to generate AI-created:
- Songs
- Lyrics
- Instrumentals
- Album artwork
All user interaction is through text prompts only.
Eustasia does not allow uploading of images, audio, or other media.
AI generation relies on third-party providers such as FAL.ai and the Minimax v2 model ("AI Model Providers").
3. User Input
"User Input" means the text descriptions, prompts, and instructions you submit.
You agree not to submit:
- Copyrighted or proprietary lyrics you do not own
- Hate speech, racist content, slurs, harassment, or abusive content
- Threats, extremist content, or calls for violence
- Anything illegal, harmful, or intended to deceive
- Attempts to prompt the model into producing disallowed content
You retain ownership of your User Input.
You grant us permission to process it solely to generate AI Output.
4. AI-Generated Output
"AI Output" includes all music, lyrics, audio, and artwork generated by Eustasia in response to your Input.
4.1 Ownership & Commercial Use
Subject to these Terms, you own all rights to the AI Output generated by your account.
You may use your generated songs for any lawful purpose, including:
- Commercial projects
- Streaming
- Distribution
- Monetization
- Uploading to platforms such as YouTube, TikTok, Spotify, Apple Music, etc.
We do not claim ownership of your AI Output.
5. Acceptable Use
You agree not to use Eustasia to generate, publish, or distribute:
Prohibited Content
- Hate speech, racist content, slurs, or discriminatory language
- Harassment, bullying, or targeted abuse
- Violent or extremist content
- Copyrighted lyrics or text you do not own
- Content intended to impersonate real artists or public figures
- Illegal or harmful material
- Automated scraping, bots, or attempts to reverse engineer the model or Service
- Prompting the model to generate disallowed content
Violations may result in account suspension or termination.
6. Credits, Purchases & Subscriptions
Eustasia may offer:
- Credit packs
- Weekly or yearly subscription plans
- Promotional credits
6.1 Credit Usage
Each generation uses a set number of credits.
Credits are:
- Non-refundable
- Non-transferable
- Not redeemable for cash
6.2 Subscription Billing
Subscriptions renew automatically unless canceled through the Apple App Store at least 24 hours before renewal.
Billing and refunds are handled exclusively by Apple.
6.3 All Purchases Are Final
Except where required by law, all purchases—including subscriptions and credits—are final.
7. Third-Party AI Providers
By using the Service, you agree that your text prompts may be sent to AI Model Providers (such as FAL.ai and Minimax v2) for processing.
We are not responsible for:
- Third-party outages or downtime
- Unexpected model behavior
- Inaccurate or undesired outputs
These providers may retain anonymized data for model improvement.
8. Model Limitations
You understand and agree that:
- Results vary and may not match expectations
- AI Output may resemble existing works by coincidence
- We cannot guarantee the legal copyright status of AI-generated works in every jurisdiction
- Errors, artifacts, or unexpected behavior may occur
- The Service is not suitable for generating copyrighted lyrics or recreating known songs
You use the Service at your own risk.
9. Privacy
Your use of the app is governed by our Privacy Policy.
Generated songs and artwork may be stored temporarily (e.g., 24 hours) for user access before deletion.
10. Termination
We may suspend or terminate access to the Service if:
- You violate these Terms
- You generate disallowed content
- Your activity creates legal, security, or operational risk
- Required by law or third-party provider rules
Unused credits may be forfeited upon termination.
11. No Warranty
The Service is provided "as is" and "as available."
We disclaim all warranties, including:
- Fitness for a particular purpose
- Accuracy
- Reliability
- Non-infringement
- Uptime guarantees
12. Limitation of Liability
To the fullest extent permitted by law, our total liability will not exceed the greater of:
- $50 USD, or
- The amount you paid in the last 6 months
We are not liable for any indirect, incidental, or consequential damages.
13. Indemnification
You agree to indemnify and hold us harmless from claims arising out of:
- Your use of the Service
- Your User Input
- Your AI Output
- Your violation of these Terms
14. Changes to Terms
We may update these Terms at any time.
Continued use constitutes acceptance of the updated Terms.
